RANK FIRST DIRECTORY

Terms and Conditions

These terms explain the conditions for using Rank First Directory and submitting business information. Please read them with our Privacy Policy, Cookie Policy and Listing Guidelines. They do not remove rights that the law gives you.

1. About us and the service

Rank First Directory is operated by Rank First SEO LTD, registered in England and Wales, company number 16574759. Registered office: 2 Peel Court, 24 St. Cuthberts Way, Darlington, England, DL1 1GB. Contact: rankfirstseolimited@gmail.com.

We provide a business discovery and listing service. Unless we expressly agree otherwise in a separate contract, we do not supply the goods or services advertised by listed businesses, act as their agent, arrange their transactions or hold customer payments. Any purchase or service agreement you make with a listed business is between you and that business.

2. Checking a business before you use it

Listings may be supplied by business representatives or adapted from openly licensed sources. An unclaimed listing does not mean that the business has joined, paid for, approved or endorsed this directory. Inclusion, a photograph, a category or search position is not a recommendation, accreditation, verification of identity or guarantee of qualifications, insurance, safety or quality.

Information can be incomplete or change. Before instructing a business, check its identity, current contact details, services, price, qualifications, insurance and any legally required professional authorisation directly. Category images may be illustrative stock photographs and are not evidence of the premises, staff or work of a particular listed business. We do not invent customer reviews.

3. Submitting or managing a listing

You must be at least 18 and have authority to represent the business you submit. You must give accurate, current information, select appropriate categories, identify the business honestly and promptly request corrections when details change. Keep account credentials secure and tell us if you suspect misuse. Guest submission does not remove these responsibilities.

Only publish contact details, logos, photographs and other content you have the right to use and share. Do not publish another person’s private contact details, home address or sensitive information without a lawful reason. Where you provide personal information, you are responsible for your own data protection obligations as appropriate.

A submission is a request for publication, not a promise that a listing will go live. We may review it, ask for reasonable evidence of authority, correct formatting or classification, refuse duplication and reject material that breaches these terms. Do not submit false ownership claims or impersonate another business.

4. Acceptable use and content

You must not use the directory to publish unlawful, misleading, defamatory, discriminatory or infringing material; fake reviews; malware; spam; unauthorised personal data; or content promoting unlawful activity. Do not interfere with security, bypass access controls, overload the service or use accounts to harass others. Do not scrape private account information or send unlawful unsolicited marketing to directory contacts.

Business contact details being publicly visible does not give permission for every form of marketing. Users of those details must comply with data protection, electronic marketing and other applicable laws.

5. Your content and our intellectual property

You keep ownership of content you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, format and display it as reasonably necessary to operate, maintain and promote your listing and the directory. This includes use by hosting and technical providers for those purposes. We do not take ownership of your trade marks.

The licence ends for removed content when it is no longer needed for those purposes, subject to reasonable backup cycles, records of disputes and legal obligations. It does not require us to retrieve copies already lawfully made by independent third parties. A new unrelated use of your content would need an appropriate separate basis.

Our original branding, design and written material are protected by intellectual property rights. OpenStreetMap-derived data remains subject to its own licence and attribution terms, including applicable ODbL rights. Nothing here removes those open-data rights or another third party’s licence conditions.

6. Moderation, suspension and removal

We may edit, restrict, suspend or remove a listing or account for a reasonable reason, including inaccurate content, a credible ownership dispute, infringement, abuse, security concerns, a legal requirement or breach of these terms. Where appropriate, we will explain the reason and allow a response. Urgent legal, safety or security issues may require action before notice.

You can report a listing, request removal or ask for a moderation decision to be reviewed using our complaints and listing removal procedure. A report does not automatically establish wrongdoing, and removal of material is not an admission of liability. We will consider relevant information fairly.

7. Fees, visibility and paid services

The basic listing service is currently free. A free listing creates no obligation to buy SEO, advertising or another service. We do not guarantee enquiries, sales, traffic, search position, backlinks, indexing or rankings on Google or any other service.

If we offer paid services, the price, duration, scope, renewal arrangements and applicable cancellation terms must be clearly provided and agreed before an order is placed. These website terms do not authorise an unagreed charge or automatic renewal. Statutory consumer cancellation and service rights apply where relevant. Paid placements, if introduced, must be identified clearly.

8. Availability and external websites

We aim to keep the directory useful and available, but it may be interrupted by maintenance, faults or events outside our reasonable control. We may make reasonable changes to the service. We do not promise uninterrupted access or that every error will be prevented. Links to third-party websites are provided for convenience; their content, contracts, privacy practices and security are their responsibility.

9. Responsibility and limits

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be excluded or limited. Nothing restricts your mandatory consumer rights.

If you use the service as a consumer, we remain responsible for loss or damage that is a reasonably foreseeable result of our breach of these terms or failure to use reasonable care and skill, subject to applicable law. We are not responsible for a listed business’s separate performance merely because its details appear here.

If you use the service in the course of business, and only to the extent the law permits and the limitation is reasonable, we are not liable for indirect or consequential loss or loss of profit, revenue, anticipated savings, goodwill or business opportunity arising from use of the directory. Subject to the exclusions that cannot lawfully be limited, our total liability to that business under these website terms is limited to the greater of £100 and the fees it paid us for the directory service concerned in the 12 months before the event giving rise to the claim. A separate signed service agreement may provide different limits for that service.

A business submitting content is responsible for reasonably foreseeable losses and reasonable third-party claim costs caused by its unlawful content, lack of authority or material breach of these terms, to the extent it is at fault. We must notify it promptly where practicable, take reasonable steps to reduce loss and cooperate in the response. This paragraph does not apply to consumers, impose liability for our own fault or permit a settlement in that business’s name without its agreement.

10. Changes, disputes and applicable law

We may update these terms for a valid reason, such as a legal change, new feature or security requirement. The date above identifies this version. Changes do not retrospectively alter an existing paid contract without a lawful basis or agreement. Where a material change requires notice or renewed acceptance, we will provide it.

Please contact us first if there is a problem so we can try to resolve it. These terms are governed by the law of England and Wales. Business users agree to the courts of England and Wales. A consumer retains any mandatory protection of the law of the UK country where they live and any right to bring proceedings in their home courts. A term found unenforceable does not invalidate the remaining terms; a failure to enforce a term on one occasion is not a waiver of it.
